Exceeding 0.60 mg/l breath (1.2 g/l blood) is a criminal offence (Spanish Criminal Code art. 379.2), with possible prison of 3–6 months. Refusing the test is also an offence.
2026 context: on 18 March 2026 Congress rejected lowering the general blood limit to 0.2 g/l — previous limits still apply. From 7 July 2026, new cars and light vans must have alcolock pre-installation (EU Regulation 2019/2144).
